Marketing Module and Video Products Terms and Conditions
For Marketing Module orders of four units or more only: Includes one Filming Date for every two properties subscribed to the Marketing Module Product. Filming Dates can be used for any properties within the same subscription. Additional Filming Dates may be purchased by Client pursuant to an Order. Filming Dates that are not used within a 12-month period after the Subscription Term Start Date set forth on the applicable Order will expire and do not roll over to future periods.For Marketing Module orders of less than four units only: Includes one Filming Date for each property subscribed to the Marketing Module Product. A “Filming Date” is defined as any day a particular VTS video crew is dispatched to shoot video tour content. All scheduling for Filming Dates will be by mutual agreement and pursuant to the terms of the Subscription Services Agreement. Upon Client's request to utilize a Filming Date, VTS will use commercially reasonable efforts to schedule a mutually acceptable day that is within thirty (30) days of Client's request. VTS requires no less than four (4) business days’ notice of any request to cancel or reschedule a Filming Date, regardless of reason (including weather). VTS will use reasonable efforts to accommodate Client’s requests for specific dates and times, but it may not be possible to accommodate all dates and turnaround timing.Client’s Responsibilities:The building manager or a representative from the Client must be available to meet VTS at the property to be filmed to provide access to the VTS film crew. The representative must be available to provide access to lobby areas, amenity areas, and spaces that are to be filmed. Client must ensure that it has the necessary permissions from the property owner or manager to enter the property and film the video. All areas to be filmed will be ready for filming prior to the arrival of the Film Crew. The VTS Film crew cannot provide any assistance with cleaning, repairing, moving, lifting, shifting any furniture, fixtures, walls, floors, ceilings, etc. that are in the building or its spaces. It is also not possible to digitally edit out any said furniture, fixtures, walls, floors, ceilings, etc., thus the spaces and building areas must be in the condition desired by the Client for filming.The jointly approved videos created by VTS will be uploaded to the Service and may be viewed from within the Service. Any videos created by VTS are the proprietary property of VTS, unless otherwise agreed to by the parties in writing.If Client requires VTS to provide insurance documents in order to shoot on premises, a request and specific requirements for these documents must be provided at least 5 business days prior to the Filming Date.Please Note: You are entering into a legally binding agreement.Last Revised on: May 11, 2017
